Audrey also advises employers on state and federal employment in all aspects of personnel matters.
Audrey has represented regional and national developers and homebuilders, energy and green businesses, food and hospitality businesses, technology and manufacturing companies, financial institutions, medical and health care professional groups, and marketing and communications businesses.
Audrey’s employment practice encompasses advising and defending employers against claims involving state and federal laws, counseling on effective litigation avoidance and risk management on all aspects of personnel matters, and implementing and applying employment policies and procedures.
Audrey’s employment practice encompasses discrimination and harassment claims including sex, race, age, religion, disability and medical condition; wrongful termination; employee discipline; negotiations on reasonable accommodations for disabilities and compliance with disability and medical leave laws; employee privacy; wage and hour claims; layoffs, reductions in force, furloughs and severance; theft of trade secrets, proprietary information and anti-raiding claims; breach of employment, compensation, severance and commission contract claims; employment related torts including defamation, negligence, intentional and negligent infliction of emotional distress, fraud and misrepresentation.
Audrey has handled a wide variety of disputes for her clients, including:
- Defense of a software company against wrongful termination and related intellectual property claims brought by a former executive
- Both enforcement and defense of non-disclosure, non-competition, anti-raiding, and non-solicitation agreements
- Prosecution of $100 million dollar claim for breach of contract and misrepresentation claims by one of the largest international Dutch agricultural investment banks against one of the largest English banks and several corporate officers and directors in connection with a loan buy-out agreement
- Litigation on behalf of homebuilders enforcing owner occupancy agreements against speculators; fraudulent purchases; breach of warranty claims; and home purchase contracts
- All manner of contract and tort litigation; disputes relating to land sale acquisitions, land purchase and sale agreements, and option agreements and; including claims for specific performance, breach of contract and rescission
- Both prosecution and defense of fraudulent sale of businesses and partnerships, and related contract and tort claim
Prior to joining Morgan Miller Blair in 1997, Audrey worked at the Genesis Law Group in San Jose, where she practiced business and employment litigation.
